Protecting your fundamental rights

From our inception 125 years ago, the firm has placed civil liberties and human rights at the core of its business.

It is through our philosophy, commitment and expertise that we have earned our hard and long standing reputation and we are proud to remain at the cutting edge.

We have a track record of ensuring that a fair balance is struck in the exercise of power by authorities against the individual.

Elaine Motion  and the firm are both ranked band 1 by Chambers UK in this field.

Challenging the status quo

We understand that clients who bring cases challenging a decision of a public body, the constitution or the administrative structure in the public sector, feel daunted and must invest a great deal of trust in their lawyer.

If you use our Public Law or Judicial Review services you can be assured of the attention and be confident in us given our significant expertise and success.

Leading the way in changing the law

We work closely with Taylor & Kelly (and in particular Tony Kelly) who are highly recognised for leading the way in civil liberties.

We have been involved in litigation which has been instrumental in the development of human rights law in Scotland both for individuals and authorities across a number of fields of law including:

  • regulatory
  • voting
  • prisoner rights
  • data protection
  • freedom of information

George McGeoch v Scottish Legal Aid Board

The petitioner challenged, by way of judicial review, decisions of the Scottish Legal Aid Board to refuse him funding to pursue court proceedings. The petitioner was successful in establishing that there were deficiencies in the Board’s decision making process.

The court found and declared the decisions unlawful and found that the Board has failed to engage with the points made on behalf of the petitioner and could not be excused from  corporate responsibility appropriately to address all applications made to it.
