About Fred

I have spent my entire professional life of 40 years at Balfour+Manson, starting as an apprentice in 1973, becoming a partner in 1978, Head of Litigation in 1995, and Chairman from 2005-2014.

During that time I have been almost exclusively engaged in high value civil litigation, mostly in the Court of Session but with an international aspect to my practice. As a representative of the firm, I regularly attend conferences run by the Parlex Group of European Lawyers, of which we are members.

Specialist area

My main specialist areas are personal injury and medical negligence.  I have a particular interest in brain injury and I handle both traumatic brain injury and birth injury cases. 

I took the case of Macfarlane v Tayside Health Board [1999] UKHL 50 to the House of Lords and appealed Montgomery v Lanarkshire Health Board [2013] CSIH 3 to the Supreme Court. The Supreme Court ruled in favour of my client which was a momentous decision that will affect the doctor-patient relationship throughout the whole of UK.

I have combined my personal injury expertise with a series of aviation cases, both military and civilian which, by their very nature, are often multi party actions. 

  • I was involved in the Chinook Disaster as far back as 1986 and in the Chinook Mull of Kintyre disaster. 
  • I was on the steering committee for the claimants in the Piper Alpha and Lockerbie Disasters.
  • I was involved in the Brent Spar, Cormorant Alpha and Super Puma helicopter crashes in the North Sea. 
  • I have acted for claimants in the Nimrod accidents in Canada and in Afghanistan. 
  • I also acted for the claimants in two House of Lords cases involving helicopter accidents.

I also have extensive experience of defamation in the Court of Session for claimants and defenders alike and of general commercial litigation. 


  • I am a First Tier Tribunal Judge in Criminal Injuries Compensation and in Social Security. 
  • I was APIL Executive Committee member for Scotland for 8 years
  • I have sat for many years on the Court of Session Rules Council; the Court of Session Personal Injuries User Group; the Lord President’s Advisory Committee on Fees; and the Civil Justice Committee of the Law Society of Scotland.

I am ranked Band 1 in personal injury and clinical negligence by both Chambers and Legal 500
